1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your use of the website luvtulum.com and any sub-pages (“Site”), and your relationship with LUV TULUM ECO-RETREAT (“we”, “us”, “our”, “Luv Tulum”). By accessing or using our Site, services, and booking systems, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Site.
2. Bookings & Reservations
2.1 Room Reservations
The Site may provide information about rooms and availability but may not always process direct online bookings. In cases where online booking is unavailable, reservations must be completed through specified contact channels.
All bookings are subject to our availability, terms of payment, and pricing at the time of reservation.
2.2 Payment Terms
Prices listed on the Site are in U.S. Dollars (USD) unless otherwise stated and may change without notice prior to final confirmation of your reservation.
We cannot always accept American Express via our online booking system; alternative payment methods may be required.
Full or partial prepayment may be required to secure a reservation.
3. Cancellation & Refund Policy
Your cancellation rights and any applicable refund will be governed by our Cancellation Policy, as detailed in the FAQ or booking communications.
Specific cancellation fees may apply depending on timing, room type, and booking conditions.
4. Use of the Site
4.1 Eligibility
You may use the Site only if you are legally capable of forming binding contracts and are not barred from using services under applicable law.
4.2 Accuracy of Information
We strive to keep information on the Site up to date (including room descriptions, amenities, dining hours), but we cannot guarantee accuracy and disclaim liability for errors or outdated content.
4.3 User Conduct
You agree not to misuse the Site (e.g., submitting harmful code, unlawful content, or interfering with site operations).
Interactions via our contact form and other communication tools must be respectful and lawful.
5. Third-Party Services
The Site may link to third-party sites (e.g., tours, guides, social media links). We do not control these third-party services and are not liable for their content, privacy practices, or actions.
6. Dining & Special Services
Dining menus, hours, and special packages (including weddings, tours, honeymoon packages, private excursions) are subject to availability and may change without notice.
Participation in special services may require additional terms and separate agreements.
7. Guest Responsibility
Guests must abide by local rules and regulations while on property.
Pets are not permitted on the premises.
Children under certain ages may stay free only as described in our FAQs.
You are responsible for your own travel arrangements, itinerary, and personal items.
8. Privacy & Data
A separate Privacy Policy governs how we collect, use, and disclose your personal information. By using the Site and booking services, you consent to our privacy practices.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, and design, is owned or licensed by Luv Tulum and protected by copyright and other intellectual property laws.
10. Limitation of Liability
To the maximum extent permitted by law, Luv Tulum and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site, bookings, or stay.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Quintana Roo, Mexico, without regard to conflict of laws principles.
Any dispute arising under or relating to these Terms shall be resolved in the appropriate courts of Tulum or Quintana Roo.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Revised Terms will be effective when posted on the Site with an updated date.
